Witnesses say that the Historic Burke County Courthouse is haunted. At least two legends are thought to be the cause of this ghostly activity. On October 21, 1851, Burke County legislator William Waightstill Avery murdered Samuel Fleming of Yancey County over a long standing feud and estate dispute. Fleming’s ghost is said to haunt the halls of the courthouse. In 1833, Frankie Silver was hanged on the courthouse grounds for the murder and dismemberment of her husband. Her story has been written about in several books and folk songs. Witnesses say that her ghost can be seen walking the courthouse grounds and sobbing. The apparition will disappear if approached.
